Membership Terms and Conditions

The following terms pertain to Auto-Renewing Subscriptions Only:
Subscriptions are typically automatically renewed upon expiration--please read the terms of your membership at the time of purchase which will outline the minimum required billing cycles which vary by subscription. After the minimum required billing cycle, subscriptions will continue to auto-renew monthly unless suspended or cancelled.  Please read cancellation terms below for details.  When renewing, the associated renewal fee will be billed to the credit card maintained on your account.

Cancellation Terms:
Cancellation of recurring subscriptions or memberships can be done by emailing the studio at [email protected]. Cancellations are never taken over the phone or in person.   Any subscription may be cancelled within 3 business days of initial sign up by delivering written notice to [email protected] within 3 business days after sign up. The notice must say that you do not wish to be bound by the contract. If you cancel, Darling Yoga will return, within five days of the date on which you give notice of cancellation, any payments you have made. 
Subscriptions may also be cancelled at any time due to death or permanent disability of client or due to a move/relocation of client 20+ miles from the studio location(s). In any or all of these cases, you and/or your estate must provide a written request to cancel, in writing to [email protected], or from the “Contact Us” page of the website www.darlingyoga.com/contact. If you wish to cancel before the end of the initial contract term for any other reason, you may be subject to a termination fee equal to or up to one half the remaining balance due in the contract.

Additional Terms:
1. Membership commences on the date of sign up and amount will be charged on that date of month, each month, unless account is suspended or cancelled.
2. All memberships paid monthly are non-refundable in part or full after auto-draft has gone through under any circumstances. Memberships paid upfront are non-refundable under any circumstances.
3. Member is responsible for providing and maintaining current and accurate billing information for the monthly auto-withdrawal in the form of a credit card.
4. Darling Yoga is in no way, under any circumstances, responsible or obligated to pay for member’s insufficient fund penalties, returned checks, and/or over the limit fees. A $30 fee will be charged for all insufficient funds and returned checks.
5. Freeze Policy: Members may put membership on hold for up to 2 billing cycles once every 12 months. This option will only be inacted when requested by e-mail to [email protected].
6. Once member has submitted e-mail request for any changes to membership, it is member’s responsibility to ensure that Darling Yoga has responded back on the same e-mail account to confirm processing the request. Darling Yoga is in no way, under any circumstances, responsible for member’s negligence in checking their own bank or credit card statements to ensure that membership changes, holds, or cancellations have been processed correctly. In the event of miscommunication member is responsible to produce a copy of their request and response from Darling Yoga for review. Only then, if Darling Yoga did not perform what it agreed to do, Darling Yoga will reimburse any funds rightfully owed to member. In the event that member cannot produce a copy of e-mail correspondence with Darling Yoga then Darling Yoga is not obligated to, nor will refund under any circumstances, dues debited from member’s account.
7. Membership prices are subject to change. In the event of a change in membership price increase. Members will be notified via email of any price increase to their memberships. They will be notified one month or more prior to the change with the opportunity to submit a 30 day written cancellation or change notice.
8. Class schedule is subject to change without notice. Please check our website for up to the minute changes, additions, and/or cancellations. No refunds are given for inclement weather or other unforeseen circumstances that cause the studio to close.
9. Memberships are non refundable and non transferable.

Waiver of Liability

I hereby agree to the following:
1. I am participating in classes or services during which I will receive information and instruction about wellness and health. I recognize that activities I participate in require physical exertion, which may be strenuous and may cause physical injury, and I am fully aware of the risks and hazards involved.
2. I understand that it is my responsibility to consult with a physician prior to and regarding my participation in any physical fitness program. I represent and warrant that I have no medical condition that would prevent my participation in physical fitness activities.
3. In consideration if being permitted to participate in the offered classes, I agree to assume full responsibility for any risks, injuries or damages, known and unknown, which I might incur as a result of participating in the program.
4. In further consideration of being permitted to participate in the offered classes, I knowingly, voluntarily, and expressly waive any claim I may have against the instructor, the owner, or the leaseholder of the building for injuries or damages that I may sustain as a result of participating in classes or workshops.
5. I hereby grant permission to use my likeness in a photograph, video or other digital media in any and all of it’s publications, including web-based publications and marketing without payment or other consideration.
I have read and fully understand and agree to the above terms of this Liability Waiver Agreement. I am digitally signing this agreement voluntarily and recognize that my digital signature serves as complete and unconditional release of all liability.
